Refund Policy

This Refund Policy governs cancellations, refunds, and returns for purchases made through wyachts.shop. Because W Yachts Monaco operates across distinct product categories — yacht sales, charters, advisory services, courses, and merchandise — each category has its own refund terms, set out below.

By placing an order you accept these terms. Where European consumer law grants stronger rights, those rights apply and are not limited by this policy.


1. Merchandise and books (physical goods)

Physical merchandise — including printed books, albums, branded apparel, and accessories — is covered by the EU right of withdrawal under Directive 2011/83/EU.

  • You may return unused, undamaged items within 14 calendar days of receipt for a full refund of the item price.
  • Return shipping is at the customer's expense, except where the item arrived damaged or incorrect.
  • Personalised, signed, or numbered limited-edition items are exempt from the right of withdrawal once production has begun, in line with Article 16(c) of Directive 2011/83/EU. This will be made explicit at checkout for each affected item.
  • Pre-order titles may be cancelled at any time before they enter production. Once we have placed the print order with our publisher (typically 7 days before the announced shipping date), pre-orders for personalised or signed editions become non-refundable.
  • Refunds are issued to the original payment method within 14 days of our receiving the returned item, or earlier confirmation of cancellation for pre-orders.

2. Yacht charters (services)

Charter bookings are subject to a structured cancellation schedule, reflecting the operational realities of crewed vessel availability:

Force majeure events — including documented mechanical failure of the vessel, port closure, or government travel restrictions making the charter impossible — entitle the client to a full refund or rescheduling, at the client's choice. Personal travel-related cancellations (illness, missed flights) are not classified as force majeure and remain subject to the schedule above. Travel insurance is strongly recommended.


3. Advisory services (1-on-1 calls, audits, retainers)

Advisory products — including 30-minute and 60-minute private calls, Pre-Purchase Technical Audits, On-Board Viewing Strategy, and Priority Acquisition Retainers — are services delivered by appointment.

  • You may cancel for a full refund up to 48 hours before the scheduled session.
  • Inside the 48-hour window, the session may be rescheduled once at no charge, or cancelled with a 50% refund.
  • Once the service has been delivered (call completed, audit report issued, retainer activated), no refund is due, in line with Article 16(a) of Directive 2011/83/EU once the consumer has expressly consented to immediate performance.
  • For Priority Acquisition Retainer engagements that run beyond 30 days, refunds for the unused portion are prorated against the retainer's monthly equivalent if the engagement is terminated by the client.

4. Yacht acquisition and brokerage

Purchases of vessels (new, brokerage, or off-market) are not concluded through the online checkout. The online listing is an invitation to discuss; the binding transaction is governed by a separate Memorandum of Agreement (MOA) signed between buyer, seller, and broker, typically on MYBA, IYBA, or equivalent standard form.

  • Deposits paid into escrow under an MOA are released or refunded strictly per the terms of that MOA — most commonly subject to satisfactory sea trial, condition survey, and acceptance, with industry-standard recourse for either party.
  • Any amount paid to W Yachts Monaco directly outside of an MOA (for example, a refundable holding deposit on an exclusive listing) is fully refundable if a binding MOA is not executed within the agreed holding period.
  • Brokerage commission is earned on closing and is not refundable thereafter.

5. Educational courses (The Yacht Closer mentorship)

Multi-month mentorship programmes — The Yacht Closer Brokers Edition and Founders Edition — are digital service products with structured live components.

  • A 14-day satisfaction guarantee applies from the date of first programme access. Within this window you may cancel for a full refund, provided you have not consumed more than 25% of the recorded curriculum or attended more than two live sessions.
  • After day 14, the programme fee is non-refundable, reflecting the personalised mentorship slot allocated and the digital content already made available.
  • Payment plans may be terminated by either party for cause; please refer to the programme enrolment agreement signed at sign-up for full terms.

6. How to request a refund or raise a dispute

Send a written request — including your order number, the product concerned, and the reason — to tomek@wyachts.com. We will acknowledge within two business days and aim to resolve within 14 days.

If you are not satisfied with our response, EU consumers may use the European Commission's Online Dispute Resolution platform. Our governing law and jurisdiction are set out in our Terms of Service.


7. Statutory rights

Nothing in this policy limits any non-waivable rights you may have under French or applicable EU consumer law, including but not limited to the right of withdrawal for distance contracts, the legal warranty of conformity (garantie légale de conformité), and the warranty against hidden defects (garantie des vices cachés).
